EQ2020 Terms of Service
EQ20/20, LLC | eq2020.com
1. Overview and Acceptance
Welcome to eq2020.com (the “Site”), operated by EQ20/20, LLC (“EQ2020,” “we,” “our,” or “us”). The Site provides information about and offers for sale HOOP-ACTION® basketball training equipment and related accessories. These Terms of Service (“Terms”) govern use of the Site and online transactions placed through it.
By using the Site or placing an order, you agree to these Terms to the extent permitted by applicable law. Important purchase-related terms also appear in our Return & Exchange Policy, Shipping Policy, Product Limited Warranty, Privacy Policy, and HOOP-ACTION® Product Safety & Liability Disclaimer. Each policy governs its respective subject; these Terms do not eliminate rights provided by those policies or by applicable law.
2. Site Use and Permitted Access
You may browse the Site, review product information, and make legitimate purchases for personal, coaching, training, school, team, or organizational purposes. You may view and print Site content for your own informational or purchasing purposes while preserving copyright, trademark, and other notices.
Except as authorized by EQ2020 or permitted by law, you may not reproduce, distribute, republish, modify, sell, or commercially exploit Site content, images, logos, video, written materials, or design elements. No ownership of intellectual property transfers to you through Site use. EQ2020 may modify, suspend, or discontinue Site features, subject to applicable obligations concerning orders already placed.
3. Copyright, Trademarks, and Product Information
Unless otherwise stated, the text, product images, designs, graphics, audiovisual works, logos, and other materials appearing on the Site are owned by EQ2020 or used with permission. They are protected by applicable intellectual-property laws. HOOP-ACTION® and other EQ2020 brand names, logos, and slogans may be trademarks or other protected identifiers of their respective owners. No license to use these marks is granted except as expressly authorized.
We make reasonable efforts to describe products accurately. Screen settings and lighting can affect how colors appear. Measurements, imagery, specifications, product availability, and descriptions may be updated. HOOP-ACTION® must be installed and operated according to its Installation & Setup Manual, accompanying warnings, and Product Safety & Liability Disclaimer. Specific product performance promises must be stated expressly in the product listing or applicable written agreement.
4. Site Security and Prohibited Conduct
You must not access data or accounts without authorization; attempt to bypass security measures; introduce malware; overload, spam, or disrupt Site operations; impersonate other users; submit unlawful or abusive material; or use automated systems in ways that interfere with Site security or operation. Ordinary browsing and lawful public search-engine indexing are not prohibited by this paragraph.
We may investigate suspected misuse and cooperate with appropriate authorities where lawful. We may reasonably restrict access to protect the Site or its users, subject to existing purchase commitments and applicable law.
5. Orders, Pricing, Bundles, and Availability
Product listings, pricing, promotions, discounts, and inventory are subject to the terms displayed when an order is placed. Adding an item to a cart does not reserve inventory. If a product is unavailable, an order cannot be fulfilled, or a material listing error is discovered, EQ2020 will contact the purchaser and provide any notice, cancellation, or refund required by applicable law before making a material change to an accepted order.
HOOP-ACTION main units are sold with a Mandatory Accessory Kit in required corresponding quantities. A purchase of a complete setup may contain separately listed and separately shipped items. Promotional offers, quantity limits, gifts, and bundle pricing may carry additional posted conditions that apply to the relevant order. Applicable taxes, shipping charges, and the total payable amount are presented before the customer completes checkout, to the extent required by law.
6. Payments, Cancellations, and Returns
Payments are processed through the payment methods and providers available at checkout. Customer-requested order cancellations, voluntary returns, refund timing, approved return authorizations, and restocking fees are governed by our Return & Exchange Policy. For an approved voluntary cancellation before shipment, no restocking fee or payment-processing cancellation deduction applies, as provided in our Return & Exchange Policy.
For eligible voluntary returns, prior EQ2020 authorization is required. Returns of functioning HOOP-ACTION setups ordinarily must include the main unit, its Mandatory Accessory Kit, and other included promotional items as described in the Return & Exchange Policy. EQ2020 inspects every returned item before deciding ordinary refund eligibility. Statutory return, refund, and defective-product rights are not limited by this paragraph.
7. Shipping, Delivery, and Geographic Coverage
Standard online shipping is offered only to eligible delivery addresses in the contiguous forty-eight (48) United States, as identified in the Shipping Policy and checkout. Shipment timing, tracking, customer address responsibilities, carrier delays, delivery problems, and special shipping requests are governed by the Shipping Policy and applicable law.
EQ2020 does not routinely arrange international delivery. A customer who purchases for eligible domestic delivery and later transports the product overseas remains subject to applicable customs and transport requirements, without a promise of overseas repair facilities or international shipment of warranty replacements. Any separate international shipment requires advance written agreement.
8. Product Limited Warranty, Safety, and Customer Support
HOOP-ACTION® products and designated covered accessories may carry a separate written Product Limited Warranty. That warranty provides a ninety (90)-day limited period for eligible manufacturing defects, subject to its terms and applicable law. Warranty claims, authorized returns, inspection, repair, tested replacement units, or applicable refunds are determined under that warranty. For safe installation and use, read and follow the HOOP-ACTION® Product Safety & Liability Disclaimer, the Installation & Setup Manual, and all product and packaging warnings. The safety notice is supplemental guidance and does not replace the Limited Warranty or applicable product-liability rights.
For questions about orders, returns, installation, safety, or warranty service, contact support@eq2020.com. Stop use if a product appears unsafe. Customers should not ship any product for inspection or service before receiving written return authorization and shipping instructions.
9. Customer Comments, Feedback, and Submissions
EQ2020 welcomes questions, reviews, and feedback. You retain ownership of original content you submit, subject to rights you already grant to others. You permit EQ2020 to receive, store, review, and use submissions as reasonably necessary to respond to you, address service issues, operate the Site, and improve products and services, in accordance with applicable law and our Privacy Policy.
You are responsible for ensuring that the material you submit is lawful and does not infringe others’ rights. Please do not submit confidential inventions, unpublished business plans, or proprietary materials unless we have separately agreed in writing to receive them under confidentiality obligations. We will seek any additional permission required before using an identifiable customer’s photograph, video, or testimonial in advertising.
10. External Websites and Privacy
The Site may contain links to third-party websites, carriers, payment services, or other services not controlled by EQ2020. Their practices and terms may differ from ours. The collection and use of personal information through our Site are described in the EQ2020 Privacy Policy and, where applicable, Your Privacy Choices page.
11. Site Access and Termination
You may stop using the Site at any time. EQ2020 may suspend or restrict access where reasonably necessary to address prohibited conduct, security concerns, or other lawful reasons. Suspension of Site access does not cancel an existing paid order, remove a customer’s receipt, or diminish any nonwaivable warranty, refund, or consumer-protection rights.
12. Website Disclaimer
To the extent permitted by law, the Site and its online features are provided on an “as available” basis. EQ2020 does not guarantee that the Site will operate without interruption, network error, or unauthorized third-party interference. This website-services disclaimer does not apply as a blanket exclusion of product safety responsibilities, nor does it disclaim or replace the separate HOOP-ACTION® Product Limited Warranty, Product Safety & Liability Disclaimer, express product representations, or any implied warranties and other rights that cannot lawfully be excluded.
13. Limitations of Liability and Indemnification
To the extent permitted by applicable law, EQ2020 will not be responsible for indirect or consequential economic losses arising solely from interruption of or inability to use the Site, such as lost business opportunities due to temporary website unavailability. This provision is limited to Site-service issues and does not exclude or reduce rights or remedies that applicable law does not allow us to limit, including applicable obligations involving defective goods, refunds, personal injury, or property damage.
To the extent permitted by law, a person who unlawfully misuses the Site or submits materials that infringe third-party rights may be responsible for reasonable losses directly resulting from that wrongful conduct. This provision does not require customers to indemnify EQ2020 simply for making a legitimate warranty, return, or consumer-protection claim.
14. Governing Law, Disputes, and General Terms
These Terms are intended to be interpreted under the laws of the State of Texas to the extent permitted by applicable law. This choice of law does not override mandatory consumer protections or other governing rules that applicable law requires. Any legal proceeding concerning the Site or a purchase must be brought in a court having jurisdiction under applicable law; nothing here requires a consumer to waive rights that cannot lawfully be waived.
If a provision of these Terms is unenforceable, the remaining provisions continue in effect to the extent permitted by law. A failure to enforce a provision on one occasion does not waive its future enforcement. For a particular order, any separately agreed written terms and the applicable posted policies control their respective subjects, subject to law.
15. Updates, Contact, and Effective Date
EQ2020 may update these Terms by posting a revised version and effective date on the Site. Changes do not retroactively reduce rights or alter applicable terms governing orders completed before the change, except as lawfully agreed or permitted by law. Continued Site use after notice of a revision may constitute acceptance to the extent permitted by law.
